Personal information (“information”) protection for individuals downloading and using the MY Fresubin mobile app

“MY Fresubin” mobile app is made available and sponsored by Fresenius Kabi Australia Pty Limited (“Fresenius Kabi”), ABN 39 109 383 593. Downloading and using the MY Fresubin app, Fresenius Kabi (“we”) will collect and use certain personal information from you. This information protection statement informs how we do that.
Fresenius Kabi Australia Pty Limited is a wholly owned subsidiary of Fresenius Kabi AG located in Bad Homburg, Germany.

Why we collect and use your information
We collect and use your information for the following purposes, depending on what you have consented:
- To provide you full access to functionalities of the app and for the correct functioning of the app
- To help us keep the app secure, up to date and to further improve the app
- To send you notifications about nutrition related topics
- To download and share the information with anyone you want so you can use it to provide health plan adherence statistics to your doctor
- To provide you in app notifications then enable you to keep track of your goals
- For research and analytics to be able to develop better healthcare related to nutrition. This is done in an anonymized way.
What information we collect and how we do that
We may collect and use your personal information in the following situations:
Information provided by you
When you use the app, you will fill in information during the registration process and when completing information fields. The following information is collected:
- Name, surname
- MY Fresubin Password
- E-mail address
- Photo*
- Gender, Weight, Height*
- Date of birth*
- Health status, including pre-existing conditions*
- Ethnicity (e.g., Asian, non-Asian) *
- Mood, activity, nutrition, goals*
*Fields marked with an asterisk are optional.
Information collected by using the app
When you use the app or watch a video in the app the app will collect information on how you use the app. The following information is collected by the app
- Date and time of last login
- Number of steps (by the phone’s health suite), depending on your choice if you want to use this functionality
- The position of every video played is remembered, so if you did not finish the video, you can continue later at the position where you stopped
Legal basis for processing your information
We process your personal information on one or more of the following legal basis:
You have given us your consent. This is the case to:
- provide you full access to functionalities of the app and for the correct functioning of the app
- send you notifications about nutrition related topics
- download and share the information with anyone you want so you can use it to provide health plan adherence statistics to your doctor
- provide you in app notifications then enable you to keep track of your goals
We or a third party we work with have legitimate interests. These legitimate interests are to keep the app secure, up to date information and to further improve the app.
We share your information
We collaborate with other organizations (“recipients”) to achieve our purposes. Therefore, we may share your personal information in parts or as a whole with other organizations.
Such recipients are:
- Other Fresenius Group companies if such a transfer of personal information is required for the specific purpose (Please refer to the overview of the locations in which Fresenius Kabi Group companies are active)
- Service providers which process personal information on our behalf (they will provide technical support in the creation, maintenance and hosting of the app)
International information transfers
The information will be stored in Germany. With regards to such international information transfers to third countries, for which Australia and the European Commission has not decided that an adequate level of information protection exists, we have provided appropriate safeguards in order to secure your personal information to a degree that equals the level of information protection in Australia, and the European Union.
These safeguards are:
- Standard Contractual Clauses
- Fresenius Kabi Global Binding Corporate Rules (BCR)
How long we retain your information
Your information will be stored as long as you will use the app.
In case you stop using the app, we will send you a message after 6 months to inform you that we will remove the information after 30 days if you do not log in again.
In case you disable your account, we will remove the information after 30 days.
Requests, inquiries, and complaints
Depending on the situation you have certain rights regarding your personal information. You have the right to:
• Request access to your personal information
• Request rectification of your personal information
• Request erasure of your personal information
• Request the restriction of processing of your personal information
• Information portability
• Object on grounds specific to your situation

You also have the right to lodge a complaint with our Local Data Protection Advisor (LDPA) or the supervisory authority.
